Breaking: Court Dismisses Abuja Residents’ Suit Against Tinubu's Inauguration, Awards N20M Against Lawyer

POSTED ON June 6, 2023 •   Uncategorized      BY Akinbohun Samuel •   VIEWS 121

A Federal High Court in Abuja has rejected a lawsuit brought by five Federal Capital Territory (FCT) citizens who wanted to halt President Bola Tinubu's inauguration.

Remember that five Abuja citizens—Anyaegbunam Okoye, David Adzer, Jeffrey Uche, Osang Paul, and Chibuike Nwanchukwu—filed a lawsuit on their own behalf as well as that of other FCT residents and registered voters.

Plaintiffs claimed that Tinubu did not receive at least 25% of the votes cast in the FCT in the lawsuit filed on April 28.

They requested a court order prohibiting the Chief Justice of Nigeria (CJN), any judicial officers, and/or any authorities or people from swearing in any candidates for president or vice president in the election on February 25.

Additionally, they requested that the court invalidate Tinubu's certificate of return and prohibit the Chief Justice of Nigeria and any other judicial officer from swearing in any presidential candidate as president or vice president of the Federal Republic of Nigeria until the matter was resolved in court.

Chuks Nwachukwu, the plaintiffs' attorney, also informed the court that the plaintiffs had submitted originating motions and an ex parte application asking for the constitutional issues to be sent to the Court of Appeal for interpretation.

However, Justice Inyang Ekwo rejected the case on Tuesday due to lack of jurisdiction and locus standi.

Additionally, he awarded 20 million naira against the lawyer, Chuks Nwachukwu

In addition, Justice Ekwo commanded that the Legal Practitioners Disciplinary Committee (LPDC) be given access to the case file and all paperwork submitted in order to take the necessary disciplinary action against the attorney.

According to the judge, the plaintiffs shouldn't take any action until the N20 million award has been fully paid.
