Controversial cross-dresser Idris Okuneye, popularly known as Bobrisky filed a notice of appeal on Monday, disputing the maximum six-month sentence imposed by a Federal High Court in Lagos State.
The Economic and Financial Crimes Commission (EFCC) had indicted Okuneye with four charges of naira misuse. He pled guilty before Justice A.O. Awogboro of the Federal High Court in Lagos.
Remember that on April 12, Justice Awogboro condemned Okuneye to six months in prison without the option of a fine.
However, Okuneye's counsel, Mr Bimbo Kusanu, filed a notice of appeal, pleading with the Court of Appeal to overturn the maximum punishment.
Kusanu has asked the court to substitute the sentence with a punishment of N50,000 on each count.
In the notice of appeal, the counsel argued that the trial court imposed the maximum penalty on the appellant, who had no prior criminal convictions.
He argued that the Administration of Criminal Justice Act (ACJA) provided possibilities for imposing a shorter sentence.
He argued that the trial court's sentence against the appellant was punitive and violated the ACJA's obligatory clauses.
The appellant claimed that the trial court did not consider the appellant's positive antecedent, which included not wasting the court's time by pleading guilty to the accusation.
He added that the appellant honored the respondent's initial invitation.
