ABUJA- A Federal High Court in Abuja has brought President Bola Tinubu, Attorney-General of the Federation and Minister of Justice Lateef Fagbemi, and Senate President Godswill Akpabio before it regarding the purportedly illegal dismissal of Justice Danladi Umar as Chairman of the Code of Conduct Tribunal (CCT).
Two civil society organizations, Community Rescue Initiative and Toro Concerned Citizens Relief Foundation, along with an Abuja-based attorney, Comrade Nasir Bala, filed a lawsuit against the President and ten other people.
The three plaintiffs are requesting that the court prevent the National Assembly Clerk from forwarding to Tinubu the Senate and House of Representatives concurrent resolution that ousted Umar as Chairman of the Code of Conduct Tribunal.
On the basis that explicit legal provisions, including the 1999 Constitution, were not adhered to in the alleged removal of the CCT chairman, they are also pleading with the court to prevent the President from implementing the resolution of the two houses of the National Assembly.
The plaintiffs are suing the President and the other defendants for seven declaratory reliefs, among other things.
On behalf of the plaintiffs, Mahmoud M. Maidoki Esq., A.G. Salisu Esq., Jibrin S. Jibrin Baq., and Abubakar S. Idris Bag filed the lawsuit with the filing number FHC/ABJ/CS/1796/2024.
The procedure in question will be served by alternative means, including pasting at the court's notice board, the APC secretariat, and the Office of Secretary to the Government of the Federation, according to an order issued by Justice James Omotosho, who will decide the case.
The lawsuit was also postponed by the court until January 14, 2025.
