In a significant ruling on the disputed Osun State Governorship election, the Court of Appeal in Abuja has upheld Senator Ademola Adeleke's position as governor.
Adeleke had initially been removed from office by the Election Petition Tribunal, which had declared that he did not receive the majority of lawful votes during the 2022 gubernatorial elections in the state. However, the Appeal Court Panel led by Justice Mohammed Shuaibu has now overturned this decision, stating that the tribunal's ruling was flawed.
The panel also rescinded the tribunal's order that Adeleke's certificate of return be withdrawn and given to his opponent, Gboyega Oyetola. The panel's decision was based on the fact that the Osun State tribunal had made a mistake by accepting Oyetola and the APC's evidence that there had been over-voting during the election, arguing that this evidence alone did not prove that there was over-voting, and that the tribunal's decision was therefore incorrect.
